Purchaser Agrees to the Following:
** Please note: Breeder reserves the right to terminate this agreement for
any reason prior to delivery of the kitten. Any monies paid will be refunded to the buyer.
1) This cat, to the best of our knowledge, is healthy at the time of sale. For vaccination information on this kitten, please see the attached page on “vaccination information” and the “vaccination addendum”. This kitten/cat has___ has not___ received a Rabies vaccination on _________________. We ask that this kitten not be vaccinated for Rabies before 6 months of age. This gives the immune system a chance to mature. The use of the Feline Leukemia vaccine is not recommended. Vaccination for FeLV/FIV will void the health agreement.
2) This cat/kitten, to the best of our knowledge is free from contagious diseases, congenital defects and parasites (fleas, ticks, intestinal parasites, ear mites) at the time of sale.
3) This cat or kitten must be examined by Purchaser’s veterinarian with 72 hours of receipt. Failure to do so will result in this agreement being null and void. Cat/Kitten must be examined by Purchaser’s veterinarian by________________________________________. Please Note: cat/kitten is NOT to receive ANY vaccinations during his/her first vet visit! This is extremely important! Your cat/kitten is under stress; they have just been moved to a new home and must undergo the stress of a veterinary visit. Vaccines given during this visit could cause them to become ill.
3a) Medical problems must be brought to the Breeder’s attention immediately. Failure to notify breeder within this 72-hour period with regard to any problems will result in this agreement being null and void.
3b) If during this 72 hour guarantee period, an illness is discovered, Breeder will gladly take the kitten back and have it treated at our expense. It will be returned to the Purchaser after being deemed healthy by Breeder and/or Breeder’s vet. If Purchaser wishes to have cat/kitten treated by his/her own vet, Breeder will not be responsible for any medical expenses. If kitten cannot be brought back to sound health within one month from date returned, Purchaser may elect for a replacement kitten, when one of same quality become available. Breeder’s liability limited to physical replacement of kitten with same quality as originally purchased. Monetary refunds will not be given.
3c) This cat/kitten is guaranteed for a period of 2 years (from the date of purchase) against death from any hereditary or genetic illness. This cat/kitten is guaranteed for a period of 2 years from Hypertrophic Cardiomyopathy (HCM). ***Diagnosis of HCM must be made by a board certified veterinary cardiologist using echocardiogram with Color Flow Doppler. If the cat dies from any genetic illness, the illness or defect must be evidenced in a written necropsy report with complete histopathology from a licensed veterinarian AND the closest university teaching hospital, and must be presented to the breeder. Verification of any and all findings of Purchaser’s vet will be done by Breeder’s vet. Upon satisfactory verification of these findings by the Breeder’s vet, cat/kitten will be replaced with a cat/kitten of equal quality, breeding, sex, and price as soon as available. Breeders choice on the specific kitten that will serve as replacement.
3d) Elective Euthanasia by the Purchaser without first contacting the Breeder will void this agreement, the only exception being in emergency situations, in which case the breeder should be notified as soon as possible.
3e) Breeder requires that kitten/cat be quarantined from any existing animals in Purchaser’s home for a minimum of 72 hours or until after the first vet check is made. If kitten is not quarantined for a minimum of 72 hours(or until first vet check is made), 72 hour guarantee becomes null and void and cat may not be returned to Breeder if an illness is found at the first vet check.
Any animal going into a new environment will stress. Stress can cause slight upper respiratory problems (slight runny eye or nose), diarrhea, increased temperature, and sometimes vomiting. Slight symptoms are considered normal. Contact Breeder immediately for instructions, should your cat/kitten show symptoms of stress.
4) This cat/kitten is being fed__________________________________________________
__________________________________________________.
Cat/Kitten should remain on this diet for a period of one month. If food is changed, digestive upset may occur. When/if foods are switched; it is wise to do so over time.
5) Purchaser agrees that this cat/ kitten will receive kind medical attention when necessary. Failure to seek prompt medical attention for any illness or injury will render the health guarantee null and void.
6) Breeder is not liable for any contagious illness (FELV, FIV, Rhino, calici, ect.) once the cat/kitten leaves POCKET LEOPARDS CATTERY. The only exception is FIP (see # 7 below for details).
7) This cat/kitten cannot be guaranteed to be free from Feline Enteric Corona Virus (FeCV). It is estimated by a research physician at the University of Missouri Veterinary Teaching Hospital that 93.7% of all cats have contracted Feline Enteric Corona Virus. FeCV can, on rare occasions, “mutate” and cause the fatal disease Feline Infectious Peritonitis (FIP). The effectiveness of the FIP vaccine is still controversial. Many researchers and veterinarians believe it can create enough stress on the feline immune system to actually cause the disease, others believe that it is completely ineffective. Although research is continuing, at this time no one knows exactly why this disease occurs, or how to completely prevent it. Therefore, this entire health guarantee is null and void if the FIP vaccine is administered to this cat/kitten. Once again, the breeder cannot guarantee that this cat/kitten will never contract this disease. No breeder can. However, should this cat/kitten die from FIP within one year of living in its new home, breeder will replace the cat/kitten with one of breeders’ choosing under the following conditions:
a) Complete necropsy, histopathology and microscopic examination of tissue by a trained pathologist must be performed.
b) Written and signed necropsy report must be received by the breeder.
c) If you have a multi-cat household, two Corona Virus Titers, six (6) weeks apart must be performed on the remaining cats (this is a simple blood test, sent via U.S. express mail).
d) If you have a single cat house hold, a waiting period of six (6) weeks from the time of death must occur.
Pocket Leopards does everything possible to prevent this disease from occurring. For more information on this disease, please visit these websites: www.orionfoundation.com and/or www.dr-addie.com
8) Cat/kitten MAY NOT be de-clawed. We recommend that the cat/kitten’s nails be trimmed every 7-10 days and that Purchaser provide lots of scratching posts for the cat/kitten’s use. (“Soft Paws” claw caps may be used if necessary). If cat/kitten is declawed, the health/replacement guarantee is void.
9) Kitten/cat may not be allowed to roam freely outside. If Purchaser wishes to let cat outside, cat must be confined to an escape proof enclosure or be on a harness and leash (if on harness and leash cat must be supervised at all times. Never is the cat allowed to be tied up and left unattended)! If cat/kitten is allowed to roam freely outside, the health/replacement guarantee is void.
10) Registration papers will be provided to the Purchaser at the time of sale (if cat is already altered). If Purchaser is under a spay/neuter agreement, Purchaser must first send proof of alter to breeder before receiving registration paperwork. If kitten/cat is purchased as a pet, Purchaser must not breed said cat and must have cat spayed or neutered by 6 months of age. If Purchaser breeds the cat/kitten, POCKET LEOPARDS CATTERY shall have right to reclaim cat and all offspring of cat, and Purchaser shall waive right, title and interest in cat and all offspring. Further, Purchaser shall be liable for boarding charges, rehoming expenses, medical care expenses (including but not limited to testing for illnesses, and spay neuter of cat and all offspring) and all other expenses incurred to/by breeder for cat and all offspring of said cat.
11) If, for any reason, the Purchaser cannot retain ownership of this cat/kitten, the Breeder shall be given the right of first refusal, and/or will assist in placing the cat/kitten with a new family. If cat/kitten is physically returned to Pocket Leopards because Purchaser cannot retain ownership, Purchaser agrees to pay for FELV/FIV testing or have the cat FELV/FIV tested himself/herself first. If Breeder is able to rehome cat/kitten and receive a adoption/rehoming fee, balance of whatever adoption fee (if there is a balance left) Breeder receives from new owner will be given to Purchaser after boarding charges of $_____ per day, plus any medical expenses (if any) are taken out by Pocket Leopards. If cat is rehomed with another party or retuned to Pocket Leopards cattery for rehoming, the Purchaser shall waive any right, title or interest in the cat/kitten and this contract will become null and void. Contract not transferrable to other parties. Never is this cat to be rehomed or given away with permission from POCKET LEOPARDS CATTERY. Never is this cat, under any circumstances, to be sold to anone or sold/given away/traded to any research facility, pet shop, animal shelter, etc.
12) BREEDER ASSUMES NO LIABILITY FOR VETERINARY COSTS OR OTHER EXPENSES INCURRED BY THE OWNER. BUYER ACKNOWLEDGES THAT BREEDERS LIABILITY CAN NEVER EXCEED WHAT IS EXPRESSED IN THIS GUARANTEE AND AGREEMENT AND IS LIMITED TO PHYSICAL
REPLACEMENT OF KITTENS/CATS. Replacement cats shipped at Purchaser’s expense.
13) If for any reason the Breeder should go out of business, the health/replacement guarantee will become null and void.
14) Should the Purchaser fail to comply fully with the terms of this Sales Agreement, the Breeder shall have the right to reclaim the cat/kitten and the Purchaser shall waive any right, title or interest in the cat/kitten. The Purchaser will be responsible for any and all costs incurred by the breeder, including but not limited to, shipping, veterinary costs, Feline Leukemia testing and legal fees.
